White Tuque Inc. (“White Tuque”, “we”, or “us”) is committed to respecting and protecting your privacy. We have developed this privacy policy (“Privacy Policy”) to help you understand how we collect and use information. This Privacy Policy explains how we gather and use your information, whether in connection with our provision of the Services (as hereinafter defined) or due to your use of the Site (as hereinafter defined).
When used herein, the term “Services” shall refer to any product or services we (i) provide to you directly; or (ii) make available to or perform for you through the Site, including any landing pages or informational pages. The web page located at whitetuque.com, any mobile application that we make available to you (each a “Mobile Application”) and all linked pages together form the “Site”.
Please read this Privacy Policy carefully and review it periodically for the latest information about our privacy practices. By using the Site and/or making use of Services, you agree to the terms of this Privacy Policy and consent to the use of your information by White Tuque as set forth herein. If you do not agree with the practices described in this Privacy Policy, please do not provide us with your personal information or interact with the Site and/or continue using or taking advantage of the Services.
We will routinely update this Privacy Policy to clarify our practices and to reflect new or different privacy practices, such as when we add new services, functionality or features to the Site and/or Services. If we make any material changes, we will notify you by e-mail (sent to the e-mail address specified in your account) or by means of notice on the Site or directly delivered to you prior to the change becoming effective. You can determine when this Privacy Policy was last revised by referring to the date it was “Last Updated” above. If you do not agree to the revised Privacy Policy, please stop using the Site and/or Services.
THE INFORMATION WE COLLECT
We collect only personally identifiable information (“Personal Identifiable Information”) that is relevant and necessary to the purpose of the Services and/or Site. This information allows us to provide you with a customized and efficient experience. We collect the following types of information:
A. Personally Identifiable Information
We receive and store any information you directly provide through the Site and/or Services or provide to us in any other way, including by e-mail. When you send an e-mail to White Tuque, we may retain your e-mail address and the contents of the e-mail you send.
User Account Registration: We may ask you to complete a registration process in order to use the Services and/or the Site and as part of such registration process, we may require select Personal Identifiable Information such as your first name, last name, company name, and/or a valid email address. You can correct, amend, add, or delete any Personal Identifiable Information by contacting us at [email protected].
Payment Information: We do not collect or store any financial information. We currently contract with Xero to perform all payment processing on our behalf. Any financial information you provide through the Services is being provided directly to Xero and Xero’s use of such information is governed by their latest privacy policy, which is located here.
Non-Provision of Information: Please note that you can choose not to provide us with certain Personal Identifiable Information, but then you may not be able to take advantage of all of the Services.
In addition to the above, we may also collect personally identifiable information in the following circumstances:
- using interactive features on our Website
- participating in our surveys
- engaging with White Tuque sales representatives, including phone calls
- registering for or attending a White Tuque event
- participating in White Tuque events
- submitting web forms to us
- providing information to our partner(s)
- requesting a meeting to discuss any of our products and services
- reporting a problem
In some cases we may also receive your information from third parties, including but not limited to our partners, social media platforms, event coordinators, referrals and other data sources. We may aggregate the Information provided by you with Information we collect from third parties and use it as described in this Privacy Policy.
B. Non-Personally Identifiable Information
We also may automatically collect Site usage information, such as the numbers and frequency of users of the Site, pages visited and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that is intended to identify you personally. Aggregate information generally is collected through the use of cookies and other tracking technologies as discussed below. This aggregate information helps us determine general usage patterns and modify the Services and / or Site in order to improve our offerings. This type of aggregate information may be shared with third parties at any time.
C. Passive Gathering of Information Electronically
White Tuque receives and store certain types of information whenever you interact with the Site, including cookies and other tracking mechanisms. A cookie is a text file that is placed on your hard disk by a web page server, the purpose of which is to tell the web server that you have returned to a specific page. For example, if you register with us, a cookie helps White Tuque to recall your specific information on subsequent visits.
The website may also contain web beacons, tags, pixels, or other similar electronic files used to track user behaviours on the site. They may also be included in emails to track how many messages sent were opened, acted upon, or forwarded
In addition to the above, White Tuque uses cookies and other tools to help diagnose problems with its servers, analyze trends and administer the Site and the Services. For instance, we may contract with third parties who will use cookies on our web site to track and analyze anonymous usage and volume statistical information from our visitors and members. Rest assured that we neither rent nor sell your Personal Identifiable Information to anyone (except in the case of a business transfer as set forth below), and that we will share your Personal Identifiable Information only as described below.
A. Fulfilment of Services
We may retain other companies and individuals to perform certain functions on our behalf. Examples include, but are not limited to, companies and individuals who: (i) administer the White Tuque accounts; (ii) process payments; (iii) deliver products or services; or (iv) provide customer support, web hosting, internet service, and data analysis. C. Business Transfers
If White Tuque, or substantially all of its assets, were acquired, user information would be one of the assets transferred.
D. White Tuque Personnel
White Tuque personnel and authorized consultants and / or contractors may have access to Personal Identifiable Information, where such access is necessary in the normal course of White Tuque business.
IMPORTANT DISCLOSURES, PRACTICES AND CONTACT INFORMATION
A. Third Party Links
We are not responsible for the practices employed by web sites linked to or from our Site or Services, nor for the information or content contained therein. Please remember that when you use a link or go from our Site or Services to another web site, including those sites that have a link on our Site or Services, you are subject to that other web site’s own rules and policies. Please read over those rules and policies before proceeding. We are not responsible for such third-party site’s collection and / or usage of your data.
B. Data Security
We maintain a variety of commercially reasonable safeguards designed to protect your Personal Identifiable Information from unauthorized access and disclosure. For example, we use industry accepted tools and techniques to protect against unauthorized access to our systems.
You should be aware, however, that White Tuque has no control over the security of other web sites on the Internet that you might visit, even where such other site is linked to our Site or Services. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your information.
We take commercially reasonable steps to secure your information but do not promise, and you should not expect, that your information always will remain secure. C. Children
The Site and Services are for use only by individuals who have reached the age of majority in their jurisdiction. As such, White Tuque does not intentionally collect information about children under the age of 16. If we learn that White Tuque has collected information from a child under the age of 16, we will delete that information as quickly as possible. D. Server Location
Our servers are currently located in the United States and our business is currently operated from both Canada and the United States. As such, please be aware that your information may be transferred to, stored, and processed in Canada or the United States. The data protection and other laws of Canada and the United States might not be as comprehensive as those in your country. By using the Services or the Site, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share that information as described in this Privacy Policy.
E. No Rights of Third Parties
This Privacy Policy does not create rights enforceable by third parties.
F. Data retention
We retain all collected information for so long as we are contractually obligated to provide the Services to you, and thereafter until such time as we delete your account in accordance with our service agreements.
